Memorandum of Deposit of Title Deeds

Draft for execution and registration

This Memorandum is executed at Tumakuru on 5 October 2026 by:

Smt. Lakshmi Devi, W/o Suresh K, aged about 38 years, tailoring (self-employed), residing at Site No. 7, Hosahalli Village, Gubbi Taluk, Tumakuru District 572 216 (the Mortgagor); and
Sri Suresh K, S/o Kariyappa, aged about 42 years, driver (salaried), residing at Site No. 7, Hosahalli Village, Gubbi Taluk, Tumakuru District 572 216 (the Co-borrower),

in favour of Sample Housing Finance Ltd, a housing finance company registered with the National Housing Bank, acting through its Tumakuru Branch at 2nd Floor, B.H. Road, Tumakuru 572 101, Karnataka (the Lender).

The Lender has sanctioned a Home Construction Loan of Rs 12,00,000 to the Mortgagor and the Co-borrower under its sanction letter dated 20-09-2026, repayable in 180 monthly instalments, for the purpose of construction of a ground floor residential house on Site No. 7.
On 5 October 2026 the Mortgagor personally attended the Lender’s office at the above address and deposited with the Lender’s authorised officer the documents of title listed in Schedule A, relating to the property described in Schedule B, with the intent to create a security by way of equitable mortgage under Section 58(f) of the Transfer of Property Act, 1882, for the repayment of the loan with interest, costs, charges and all other monies payable under the loan documents.
The Mortgagor declares that the Mortgagor is the absolute owner of the Schedule B property, that the documents in Schedule A are all the documents of title to it in the Mortgagor’s possession, and that the property is free from all encumbrances, charges and claims.
The security shall also extend to any further advance made by the Lender to the Mortgagor, and shall continue until all monies due are repaid in full, notwithstanding any intermediate payment.
The Mortgagor shall not sell, lease, gift or further encumber the Schedule B property without the Lender’s prior written consent, and shall construct on it only in accordance with the building licence and sanctioned plan.
The Lender may register this security interest with the Central Registry (CERSAI) and may deal with the deposited documents as a mortgagee in accordance with law.

NOW THIS DEED WITNESSETH AS FOLLOWS:

The Purchaser has paid the entire sale consideration of Rs 6,50,000/- by RTGS, UTR No. XXXX2019111400417 (fictional), receipt of which the Vendor admits.
The Vendor hereby conveys the Schedule Property to the Purchaser absolutely, with all rights, easements and appurtenances.
The Vendor assures the Purchaser that the Schedule Property is free from all encumbrances, charges, mortgages, liens, attachments and court proceedings.
Vacant possession of the Schedule Property has been delivered to the Purchaser this day.
The Vendor shall indemnify the Purchaser against any loss arising from any defect in his title.
The Vendor shall sign all papers needed to transfer the khata in the records of Hosahalli Gram Panchayat to the Purchaser.
